GEORGE HEISSER WILL

December 24, 1830

In the name of God Amen. I George Heiser of Lawrence Township, Stark County, and State of Ohio considering the uncertainty of this mortal life and being of sound and perfect mind and memory blessed be Almighty God for the same do make and publish this my last will and testament in manner and form following (that is to say). First I give and bequeath unto my beloved wife Christina Heiser the farm on which I now live lying and being in Lawrence township County and State of aforesaid for and during her natural life on the following conditions viz my beloved wife Christina shall have possession of the aforesaid premises and shall have the land farmed as is usual to farm by any person she may agree with on the shares and shall retain for herself and for her use the one third part of all grain of whatsoever kind each years raised thereon during her natural life and also the one third part of all the Hay and any kind of produce raised thereon during the aforesaid time and I also give and bequeath unto her one of the Horde beast now belonging to me and also two cows to be chosen by herself and also two good beds and bedding and also whatever cupboard and kitchen furniture she may wish to retain all of which she is to retain for and during her natural life and provided she does not marry again but in case she should marry again then from and after that date all the above named property retained by her shall revert to and be equally divided between my children born to me by her. It is also my will that six weeks from and after my death and burial that all the personal property owned by and belonging to me except as hereinafter before excepted of that which is retained by my beloved wife shall be exposed to Public Sale and I do allowing a reasonable credit for the same and then first all debts and demands and then my beloved wife shall have the one third part of the balance of the money arising from the sale of said property and the other two third parts shall be immediately divided equally amongst my children. Namely my eldest daughter Elizabeth intermarried with John Rowe, John Heiser, Jacob Heiser, Catharine intermarried with Peter Stechler, Margaret intermarried with Michael Stechler, George Heiser and Henry Heiser and David Heiser or placed in the hands of the Guardians of those that are not twenty one years of age. It is farther my will that after the death and burial of my beloved wife as soon as practicable the beforenamed farm on which I now live shall be sold and the money arising from said sale shall be equally divided between my children before named--and lastly it is my will and wish that John Hay of Franklin Township, County and State aforesaid be and I do hereby appoint him my sole executor of this my last will and testament hereby revoking all former wills by me made.

In witness where of I have hereunto set my hand and seal this twenty fourth day of December in the year of our Lord one thousand and eight hundred and thirty one.

Signed sealed published and declared by the above named George Heisser to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator.

Witnesses:

At a Court of Common Pleas begun and held at Canton in the County of Stark and State of Ohio on the Twenty second day of April Eighteen hundred and thirty three the foregoing will of George Heiser being brought into Court H.R. Caldwell one of the Subscribing witnesses thereto being called came into court and being sworn in open Court here deposeth and saith that he saw the Testator subscribe the Said Will that he subscribed the said will as a witness in the presence of the said Testator. That the Testator at the time he subscribed the said will was of sound mind and memory was of full age and not under any restraint. At the same time appeared Jacob Hollinger an other of the subscribing witnesses to said will and being likewise sworn saith the like.

In testimony whereof I hereto set my hand at Canton the Twenty fourth day of April 1833 Jno Myers, Clerk
